When You Can Sue a Family Member for Wrongful Death

Some differences among the states exist concerning the circumstances in which family members may be sued for wrongful death actions. In some states, limited parental immunity exists for injuries resulting from a parent providing ordinary care to a child. Even in cases where state law permits one family member to be sued, that person can only be sued if he or she was negligent and responsible for causing a death.

For example, if a woman was killed in a car accident in which her husband was driving, he could only be sued if he was at fault or found to be responsible for causing the accident. A wrongful death lawsuit asserts that the victim died as a result of negligence on the part of the person being sued and that the victim’s survivors are entitled to financial compensation as a result of that negligence.

This type of claim differs from a general negligence lawsuit, which is filed by the person injured for compensation. Originally, a wrongful death claim did not exist based upon the idea that the claim died with the victim. Consequently, there was no way to compensate the victim. Accordingly, the surviving family members were not allowed to claim damages from the individual who caused the victim’s death. However, over the years, wrongful death laws have been passed by the states that provide compensation to those who may have been damaged from the death of the decedent. Today, some form of a wrongful death claim action exists in all the states.

Although the state’s “wrongful death laws” were created independently of each other, they all follow the same basic principles. The elements of each claim include:

The death was caused, in whole or part, by the actions of the defendant
The defendant was negligent or liable for the victim’s death
There is a surviving spouse, children, beneficiaries, or dependents
Monetary damages have resulted from the victim’s death

#2 – A Practice Run is a Great Idea

You should consider taking your first RV trip to…. your driveway. That’s right – think about setting up the RV completely in your driveway, or wherever it is stored, so you can practice using everything. This is a great tip because it will allow you to make any rookie mistakes while you are just a few steps from home. Getting to know how your RV works at home will take a lot of the stress out of the process of using the RV when on a trip.

#3 – Minimalism is a Great Goal

Even if you purchase one of the biggest RVs on the lot, you still aren’t going to have unlimited space inside the rig. To make sure you have room to move around and enjoy the living space, think about minimizing the items you bring with you on the trip. Most of the time, you are going to wind up only using a portion of what you bring, so think smart and try to pare down the load before pulling out of the driveway.

#4 – Plan for an RV Drive

If you just plug your destination into the navigation app on your phone, you are going to get the fastest route to the campground – but that route might not be meant for RVs. Think ahead about what kind of roads you will be willing to travel on in your RV, and plan a trip which is going to allow you to arrive safely. This is especially important in winter months when some of the higher roads might be dealing with snow and ice.

#5 – You Can Never Have Enough Gloves

The point above about packing on a minimalistic basis does not apply when it comes to gloves. You want to have plenty of gloves along for the journey, because there are a lot of manual jobs that come with owning an RV – and many of them are dirty. You should have some generic work gloves, along with some disposal plastic gloves that you can use when dealing with the sewer line.

#6 – A Mobile Toolkit

Speaking of manual labor, you are going to want to bring a fully-stocked toolkit along on all of your RV adventures. You never know what kind of repairs might be needed along the way, and you don’t want to be wishing you had brought that one key tool which is sitting on your bench at home.

#7 – Prepare for Winter

If you live in a part of the world where cold winter weather is the norm, you should prepare for that weather by getting your RV ready for the freeze. Doing things like taking the batteries out of the RV, and making sure it is covered properly, will help protect your investment for the long run.

#8 – It’s Not About the RV

It is important to remember that your trip should be about the outdoors, about spending time with family and friends, and about seeing new places. It should not be about the RV – your rig is just a piece of equipment which is used to make your trip as comfortable as it can be. Prepare your RV for the vacation you have planned and then let it perform in the background while you are out having a great time.
